Pavo TV cares about intellectual property rights of independent creators, copyright holders and other rights holders as well - we do this just by following the DMCA, and India’s Copyright Act, 1957. This policy explains how we handle claims of copyright infringement on our platform and what you need to do to submit a valid DMCA request. We also outline the rights of people who believe their content was removed by mistake.
What is a Copyright Infringement?
Common types of copyright infringement are when any user uploads, shares, streams or distributes content that falls under copyright protection without the express permission of the copyright owner (or where applicable a valid legal exception such as fair use). This includes but is not limited to:
Unauthorised movies, TV shows and web-series
Unauthorized music (tracks, albums, or live performances)
Encrypted software, games, & digital books
Unauthorized derivative works (such as edits or new meshes)
We will respond immediately to notices of copyright infringement that are reported to the contact listed below, and, at our sole discretion, may remove or disable access to any unauthorized materials uploaded or displayed on the Service.
How to File a Counter Notification
Provide the URL of the material that Google has removed or to which Google has disabled access.
If you are a copyright owner (or are acting on behalf of one) and you believe that Pavo TV is hosting or linking to infringing material, then you may submit a written DMCA (Digital Millennium Copyright Act) takedown notice that includes the following (as required by DMCA):
The signature of the copyright owner or a person authorized to act on the copyright owner's behalf.
Identification of the copyrighted work you believe to have been infringed (for example, the title of the movie, URL, or description of the protected work).
The exact URL or location of the infringing content on Pavo TV (i.e. direct link to the video streaming page, section of the app, the user upload entry).
Your full contact details: Name, postal address, phone number and a valid email address.
A sworn statement that:
You believe in good faith that the use of the content that you claim to infringe your copyright is not authorized by the copyright owner, or its agent, or by the law.
A statement that the information in the notification is accurate, and under penalty of perjury, that you are authorized to act on behalf of the owner of an exclusive right that is allegedly infringed.
Where to Send Your Notice
Send the written document to our designated Copyright Agent: Email your completed DMCA takedown notice.
Our Response to Takedown Notices
Upon receipt of a valid DMCA complaint, Pavo TV will:
Respond with an acknowledgment to your notice within 24 – 48 business hours of receipt (Indian public holidays not included).
UncoverIf you find it true then please verify with the location and described work where infringing material exists.
Take down, or block access to, the infringing content within 48-72 hours following the validation of the claim.
Email the user who posted the material in question to inform them that you’ve taken their content down as a result of the copyright complaint, as well as a redacted copy of the notice you received (removing any sensitive personal information).
Counter-Notice If you believe that Your Content was removed or access to your Your Content was disabled by mistake.
If you feel that your content was improperly removed or disabled pursuant to a mistaken or fraudulent DMCA notice, you may send us a counter-notification to our Copyright Agent. Your counter-notice must include:
Your physical or electronic signature.
What content was deleted and where to find it on Pavo TV.
An affidavit, signed under penalty of perjury, that you believe in good faith that the content was removed or disabled as a result of mistake or misidentification.
Your contact details: complete name, postal address, phone number, and email address following their submission guidelines.
Consent to jurisdiction: You agree to submit to the personal jurisdiction of the courts located in New Delhi, India (or your local jurisdiction if you reside outside India) and agree to waive any and all objections to the exercise of jurisdiction over the parties by such courts and to venue in such courts.
What Happens Next?
We will process your counter-notice and forward it to the party who filed the original claim of copyright infringement.
If the claimant fails to follow through with a lawsuit against you within 10-14 business days, under the DMCA, content will be returned by Pavo TV.
Repeat Infringer Policy
Pavo TV have a very strict "repeat infringer" policy to comply with DMCA regulations:
"Typically, content that is removed for a second violation (after being re-published) generally results in the user receiving a warning," the representative explained.
Users who get notified 3 times or more with valid notifications within 12 months are subject to have access to Pavo TV terminated indefinitely, losing all features developed on the platform (app, website, smart TV integrations).
For serious or willful acts of infringement, we do not have any obligation to provide an advance warning.
